Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of Analytics Pitfalls & Principles ("we," "us," or "our") website and services. By accessing or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

Account Registration

Subscription and Payment Terms

Subscription Plans

• •Free tier provides access to limited content
• •Premium subscription ($15/month or $120/year) provides full access
• •Subscriptions renew automatically unless canceled

Payment Processing

• •Payments are processed securely through Stripe
• •You authorize us to charge your payment method for subscription fees
• •All fees are non-refundable except as required by law
• •We may change pricing with 30 days' notice

Cancellation

You may cancel your subscription at any time through your account settings or the Stripe customer portal. Upon cancellation:

• •You retain access until the end of your current billing period
• •No refunds are provided for partial periods
• •Your account reverts to the free tier

User-Generated Content

Your Content

When you submit stories, comments, or other content ("User Content"), you:

• •Retain ownership of your content
• •Grant us a license to display, distribute, and use your content on our platform
• •Represent that you have the right to share the content
• •Understand that your content may be used to create the evolving business fable

Content Standards

You agree not to post content that:

• •Is false, misleading, or defamatory
• •Infringes on intellectual property rights
• •Contains hate speech, harassment, or threats
• •Violates privacy or confidentiality obligations
• •Contains spam, advertising, or promotional material
• •Violates any applicable laws or regulations

Content Moderation

We reserve the right (but have no obligation) to review, edit, or remove any User Content that violates these Terms or is otherwise objectionable. We may suspend or terminate accounts that repeatedly violate our content standards.

Intellectual Property

All content on our platform (excluding User Content) is owned by Analytics Pitfalls & Principles and protected by copyright, trademark, and other intellectual property laws. This includes:

• •All analytics pitfall and principle cards (29 cards total, including descriptions, principles, and examples)
• •The business fable: All chapters, characters, plot, dialogue, and narrative content are protected by copyright © 2024-2025 Analytics Pitfalls & Principles
• •Website design, graphics, user interface, and code

You may not copy, modify, distribute, sell, or create derivative works without our express written permission. Premium members are granted a personal, non-transferable license to access and view the content for personal educational purposes only.

Fable Protection: The business fable narrative, including all characters (Sarah Chen and others), plot developments, and storylines are original creative works. Any reproduction, distribution, or adaptation requires explicit written authorization.

Prohibited Uses

You agree not to:

• •Attempt to gain unauthorized access to our systems
• •Interfere with or disrupt the service or servers
• •Use automated systems to access the service (scraping, bots, etc.)
• •Share your account credentials with others
• •Circumvent any access restrictions or paywalls

Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• •Warranties of merchantability or fitness for a particular purpose
• •Warranties that the service will be uninterrupted or error-free
• •Warranties regarding the accuracy or completeness of content

User Content represents the opinions of individual users, not Analytics Pitfalls & Principles. We do not endorse or verify the accuracy of User Content.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANALYTICS PITFALLS & PRINCIPLES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY.

Indemnification

You agree to indemnify and hold harmless Analytics Pitfalls & Principles and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from your use of the service or violation of these Terms.

Termination

We may suspend or terminate your access to the service:

• •Upon your request to delete your account
• •At our discretion with or without cause

Upon termination, your right to use the service ceases immediately. Provisions that should survive termination (including payment obligations, disclaimers, and limitations of liability) will continue to apply.

Governing Law

These Terms are governed by the laws of the State of Minnesota, United States, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of courts located in Minnesota for any disputes.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through a notice on our website. Your continued use of the service after changes are posted constitutes acceptance of the updated Terms.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Analytics Pitfalls & Principles regarding your use of the service, superseding any prior agreements.
